DEKRA is approved by the Associate Administrator for Hazardous Materials Safety, Department of Transportation (DOT) to review and certify Division 1.4G Consumer Fireworks in accordance with 49 CFR 173.65. With this approval, we are able to provide our clients with a Fireworks Classification (FC-number) for Division 1.4G Fireworks.
All explosives must comply with the requirements of 49 CFR Hazardous Materials Regulations (HMR). Any Division 1.3G Display Fireworks, Division 1.4G Consumer Fireworks, and Articles Pyrotechnics 1.4G may be classed and approved by the Associate Administrator without prior examination and offered for transportation if the fireworks meets the requirements in §173.64, which requires a firework device be manufactured in accordance with the American Pyrotechnic Association (APA) Standard 87-1, IBR as part of the HMR. The Approvals and Permits Division, within DOT PHMSA’s Office of Hazardous Materials Safety processes the applications and if approved, a formal Classification of Explosives letter is issued on behalf of the Associate Administrator signifying the new explosive is approved for transportation and assigned an “EX Number”. Now PHMSA allows an alternate path for 1.4G Consumer Fireworks – a Fireworks Certification (FC-number)!
Due to recent revisions to the HMR, as a Fireworks Certification Agency of the DOT, DEKRA can now provide you with a Fireworks Classification (FC-number) for Division 1.4G Fireworks.
PHMSA revised the HMR applicable to the approval of Division 1.4G consumer fireworks UN0336 and established DOT-approved fireworks certification agencies (FCA) that provide an alternative to the DOT internal EX-number approval process for Division 1.4G consumer fireworks. Now manufacturers of Division 1.4G consumer fireworks have the option of applying to SCE, as a DOT-approved FCA, rather than applying to PHMSA. SCE will notify the manufacturer, in writing if the fireworks have been certified and assigned an FC number, or if the application is denied, and the reasons for denial. SCE now provides a convenient and cost effective alternative to apply for an EX number for Division 1.4G fireworks (see 49 CFR § 173.65).
PHMSA-2010-0320 (HM-257): Hazardous Materials: Revision to Fireworks Regulations (RRR)
PHMSA is revising the Hazardous Materials Regulations applicable to the approval of Division 1.4G consumer fireworks (UN0336 Fireworks) and establishing DOT-approved fireworks certification agencies that provide an alternative to the approval process for Division 1.4G consumer fireworks. PHMSA is also reformatting the procedural regulations pertaining to certification agencies. These actions clarify regulations with respect to PHMSA’s fireworks approval process and provide regulatory flexibility in seeking authorization for the transportation of Division 1.4G consumer fireworks.
